AGREEMENT TO TERMS
These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Pigment Therapy, a subsidiary of Elder Leaf Investments, LLC (“we,” “us,” or “our”), regarding your access to and use of the Pigment Therapy website and any related mobile application (collectively, the “Site”).
This website and its directory services are intended solely for individuals who reside in the United States. By accessing or using this site, you confirm that you are a U.S. resident. Our resources, provider listings, and information are designed to comply with U.S. laws and standards. If you are located outside the United States, we kindly ask that you do not use this website or its services.

By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content in connection with the Site. You represent that your content does not violate any rights of any third party.
We reserve the right to remove or modify user content for any reason.

Intellectual Property Infringement:
Content that infringes on any intellectual property rights, such as patents, trademarks, trade secrets, copyrights, or rights of publicity. -
Impersonation:
Impersonating any individual or entity, including the Company and its employees or representatives. -
Privacy Violations:
Content that violates the privacy rights of any third party. -
False or Misleading Information:
False or misleading information and features.
You must not upload or post any content to the Website or Services that violates or conflicts with any policies we may publish or provide from time to time.
We do not routinely pre-screen, monitor, review, or edit User Content. However, we reserve the right, at our sole discretion, to refuse or remove any User Content, in whole or in part, that we determine does not comply with these Terms or is otherwise inappropriate, objectionable, or inaccurate. We are not liable for any failure, delay, or omission in removing such User Content.
Pigment Therapy further reserves the right to format, edit, and change the manner of any User Content. Pigment Therapy can also limit or revoke the use of the Services if you post such objectionable User Content. As Pigment Therapy cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service you may be exposed to content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will Pigment Therapy be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.
You agree to promptly notify us of any unauthorized use of your User Content or any other security breach that you become aware of or suspect. When interacting with others—whether posting User Content or sharing personal or other information—please use common sense and exercise your best judgment at all times.
User Content – Reporting
If you believe any User Content violates these Terms or is otherwise inappropriate, please report it to Contact@PigmentTherapy.com. If we follow up with you on the reported matter, you agree to help with our investigation and take reasonable steps to help us fix the problem.
Content Backups
Although regular backups of User Content are performed, Pigment Therapy does not guarantee there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, User Content that is corrupted prior to being backed up or that changes during the time a backup is performed. Pigment Therapy will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of User Content. But you acknowledge that Pigment Therapy has no liability related to the integrity of User Content or the failure to successfully restore User Content to a usable state. You agree to maintain a complete and accurate copy of any User Content in a location independent of the Services.
Payments
If you make purchases or subscribe to services on the Site, you agree to provide accurate payment information and to pay all charges incurred. Payments may be processed by third-party providers (e.g., Stripe, PayPal, Google Pay, Apple Pay).
Subscriptions
Ongoing Subscriptions
Services are accessible only through a paid Subscription. Subscription fees are billed in advance. Unless you cancel your Subscription or your account is suspended or terminated in accordance with these Terms, your Subscription will automatically renew for successive terms matching your original Subscription period, as permitted by law. We reserve the right to modify your Subscription terms, including pricing, at any time. Any changes will take effect at the start of your next billing cycle following the update. We will provide advance notice of such changes; however, please note that we may not be able to notify you of adjustments to applicable taxes.
Cancellations and Refunds
You may cancel your active Subscription at any time via your account settings page. Please note that fees paid for a monthly or annual Subscription period are non-refundable. Upon cancellation, your access to the Services will end immediately, and your profile or listing will be removed from the Website at the same time.
All subscription fees paid to Pigment Therapy are non-refundable. Once a subscription is purchased, no refunds will be issued for any reason, including unused time, partial months, or early cancellation.
Please review your selection carefully before completing your purchase.
You may cancel your subscription at any time to prevent future billing; however, cancellations do not result in refunds for payments already made. You may cancel your subscription in your account page or you can contact us at: Contact@PigmentTherapy.com.
Billing
You agree to provide Pigment Therapy with accurate and complete billing information, including your full name, address, state, zip code, telephone number, and valid payment method details.
If automatic billing is unsuccessful for any reason, Pigment Therapy will send you an electronic invoice. You will be required to manually complete the full payment for the billing period by the deadline specified on the invoice.
Fee Changes
When you subscribe to our Services, you will be charged the rate in effect at the time you begin your Subscription. Pigment Therapy reserves the right to change Subscription fees at its sole discretion and at any time. Any changes to the Subscription fee will take effect at the end of your current Subscription period.
In accordance with applicable law, Pigment Therapy will provide you with reasonable advance notice of any changes to Subscription fees, allowing you the opportunity to cancel your Subscription before the new fees are applied.
If you continue to use the Services after the updated Subscription fee becomes effective, you agree to pay the new Subscription amount.
Trial Periods
From time to time, we may offer trial access to certain Services, subject to specific terms provided at sign-up. Eligibility for trials is determined at our discretion and may depend on factors such as the Service selected, your recent trial history, and whether the Service is included in a bundled offering. Access to trials may be limited by the number of trials permitted per user within a set timeframe, or by other restrictions. Additional limitations may apply regarding the combination of trials with other promotions or offers. All trials are offered solely at the discretion of Pigment Therapy.
It is very important to understand that you may not receive a notice from us when your free trial is ending, when it has ended and that payment for your Subscription is due. If you wish to avoid charges to your chosen payment method, you must cancel your Subscription prior to midnight Central Time (North America) on the last day of your trial period. If you cancel your Subscription during a free trial or while using a promotional code or other credits, you will immediately lose access to the Services and any Subscription privileges unless otherwise specified.
Promotions
If you receive a promotion (such as a discounted price, bundled Subscription, or device-specific offer), the exact terms will be provided during sign-up or in related materials. Once the promotion period ends, we will start charging your Payment Method the standard, non-promotional subscription price, unless you cancel before the promotion expires or unless otherwise stated.
Third-Party Services
The Site may contain links to third-party websites or services (including analytics providers, email marketing services, advertisers, and payment processors). We do not control and are not responsible for the content, privacy policies, or practices of any third parties. Use of third-party services is at your own risk.
Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including compliance with GDPR, CCPA, CPRA, and CalOPPA.
Disclaimer of Warranties

Limitation of Liability

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in the State of Texas.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Use of Artificial Intelligence (AI)
The Pigment Therapys website may contain content or features powered by artificial intelligence (“AI”). All AI-generated content and AI-driven features are provided on an “as is” basis and are not intended to serve as advice of any kind. We make no representations or warranties regarding the accuracy, completeness, or reliability of information or content produced by AI or AI-powered features. We disclaim any liability for AI-generated content or AI-driven features available on the Website, as well as for any outcomes resulting from your reliance on such content or features. Users are encouraged to use their own judgment and consult qualified professionals before making decisions based on automated information. We also reserve the right to modify, limit, or remove any AI-generated content or AI-powered features from the Website at any time without prior notice.
Contact Information
In the event of any dispute between you and Pigment Therapy, send a notice of dispute to Contact@PigmentTherapy.com. In the notice, provide your name, address, contact details, a description of the dispute, and the outcome you seek. You and Pigment Therapy agree to attempt for 60 days, after the Company’s receipt of a notice of dispute, to resolve informally any such dispute.
If the dispute is not resolved, YOU AND PIGMENT THERAPY AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO THIS WEBSITE OR ANY OTHER OF OUR WEBSITES, THE SERVICES, OR YOUR PURCHASE, ACCESS, VIEWING, OR USE OF SERVICES THROUGH ANY OF OUR WEBSITES WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER THE FEDERAL ARBITRATION ACT ("FAA").
The arbitration will be administered by the AAA in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by this Section 19. (The AAA Rules are available at adr.org or by calling the AAA at 1-800-778-7879.) The FAA will govern the interpretation and enforcement of this Section 19.
A neutral arbitrator will decide and the arbitrator’s decision will be final except for a limited right of review under the FAA. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the Agreement is void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. THE ARBITRATOR MAY AWARD DECLARATORY OR INJUNCTIVE RELIEF ONLY TO YOU INDIVIDUALLY TO SATISFY YOUR INDIVIDUAL CLAIM, BUT NOT RELIEF THAT WOULD AFFECT NON-PARTIES.
If you prevail on any claim that affords the prevailing party attorneys' fees, the arbitrator may award reasonable fees to you under the standards for fee shifting provided by law.
You may elect to pursue your claim in court rather than arbitration if you provide us with written notice of your intention to do so within 30 days of your purchase. Any such court proceeding will be limited solely to your individual dispute or controversy.
You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR PIGMENT THERAPY WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER, OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
If your dispute notice involves claims similar to those of at least 14 other customers, and if you and those other customers are represented by the same lawyers, or by lawyers who are coordinating with each other, you and we agree that these claims will be “Related Cases.” You and we agree that the AAA’s Mass Arbitration Supplementary Rules in effect when the Demand for Arbitration is filed, as modified by this Section 19, will apply to Related Cases. Related Cases may only be filed in batches of up to 30 individual arbitrations at a time, and those individual arbitrations will be resolved in the following manner: (i) for the first batch, each side may select up to 15 of these Related Cases to be filed and resolved in individual arbitrations under this Section 19; (ii) none of the other Related Cases may be filed or prosecuted in arbitration until the first batch of up to 30 individual arbitrations is resolved; and (iii) if, after that first batch, the parties are unable to resolve the remaining Related Cases, a second batch of Related Cases may be filed, where each side may select up to 15 of the Related Cases to be resolved in individual arbitrations under this Section 19. This process of batched individual arbitrations will continue until the parties resolve all Related Cases informally or through individual arbitrations. A court has exclusive authority to enforce this paragraph, including whether it applies to a given set of claims, and to enjoin the filing or prosecution of arbitrations that do not comply with this paragraph.
In these Terms, the term “Dispute” will have the broadest possible interpretation and will include any claim or controversy between you and us regarding these Terms, our Websites, the Services, the price of the Services, your use of the Services, your account on our Website, marketing, communications, your purchase transaction, or billing, under any legal theory including contract, warranty, tort, statute, or regulation, except disputes relating to the enforcement or validity of our or our licensors’ intellectual property rights.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed and the remaining arbitration terms will be enforced.
